In The News …. Orly Taitz’s “Birther” Lawsuit In Santa Ana Federal District Court Dismissed By U.S. District Judge Carter

Follows on the Heels of Sanctions by Georgia Federal Judge.

     In our October 19, 2009 post, we reported on a Georgia federal judge’s imposition of sanctions on local Orange County attorney Orly Taitz in a “birther” lawsuit challenging President Obama’s ineligibility for the presidency.

     Now, we can report that U.S. District Judge David O. Carter has dismissed a pending lawsuit in the Santa Ana federal court brought on the same issue by Ms. Taitz.

     As reported by Martin Wisckol in an article in the October 30, 2009 edition of The Orange County Register, District Judge Carter dismissed the locally-venued “birther” action (even though Ms. Taitz finds “birther” to be a derogatory description). Judge Carter found that federal courts do not have the constitutional power to remove a sitting president and also rebuked Ms. Taitz for what he believed were efforts by her to encourage supporters to influence his decision. Mr. Taitz is quoted as saying that she will appeal the dismissal to the Ninth Circuit Court of Appeals.
