Walker v. Giuffre Is the Case Under Review.
In Walker v. Giuffre, 415 N.J. Super. 597 (App. Div. 2010), the Appellate Division reversed a 45% fee enhancement to plaintiffs’ attorneys under the New Jersey Consumer Fraud Act and New Jersey Truth in Consumer Contract, Warranty, and Notice Act. The Appellate Division did so based primarily on Perdue v. Kenny A., 130 S. Ct. 1662 (2010) [reviewed in our prior April 24, 2010 post], where the U.S. Supreme Court majority indicated fee enhancements should be available in only rare and exceptional cases.
However, the New Jersey Supreme Court fairly recently granted certification to review the fee enhancement issue in the case in light of the Appellate Division’s reversal.
