Effect of New Law Explored in Steven Riess’ Article in August 2009 California Lawyer.
For those attorney readers practicing in the elder abuse area, there is an excellent article that is must reading in the August 2009 edition of California Lawyer. It is authored by Steven Riess and is entitled “Combating Financial Abuse of Elders.”
This article explores the expansion of protections in the elder abuse areas that occurred with the January 1, 2009 effectiveness of Senate Bill 1140, which amended various parts of the Welfare and Institutions Code. Mr. Riess explores the impact of these amendments in detail.
Among other things, Senate Bill 1140 now authorizes the recovery of attorney’s fees and costs to prevailing plaintiffs in elder abuse “undue influence” and abusive sale practice cases. (See, e.g., Welf. & Inst. Code sections 15657.5(a) and 15657.6.)
Mr. Riess is a San Francisco attorney who participated in the drafting of Senate Bill 1140.
