As reported by Debra Cassens Weiss in a January 14, 2010 post on the American Bar Association’s website, Seventh Circuit Judge Richard Posner recently chided lawyers for Rex Carr, a class action attorney who has sued his former firm for over $20 million in compensatory damages in connection with fee disputes, for “neglecting their duties as officers of the state and federal courts by failing to rein him in.” Mr. Carr apparently had brought a RICO-based action against his former firm, even though it was a rehash of claims made in prior 2004 suits that were resolved by a memorandum of understanding upheld by Illinois courts. Not only was the dismissal of the more recent federal suit upheld by the Seventh Circuit panel, but Judge Posner felt sanctions were in order for the commencement of this action.
