Guess Which Agency Suffered the Adverse Award . . .
As reported by Kiran Khalid in an August 1, 2011 post at cnn.com, a Southern District of New York federal district judge awarded the American Civil Liberties Union (ACLU) some attorney’s fees in a Freedom of Information Act (FOIA) case. Well, you say, that may not be so unusual. Well, this one is. The CIA was the agency suffering the adverse award, involving both destruction and disclosure of documents relating to detainment of two suspected al Qaeda leaders. The district court refused to sanction the CIA, but did find the ACLU did a good job in obtaining disclosure of documents--meaning that attorney’s fees should be awarded under FOIA.
