Condemnees Obtained Reversal of Litigation Expense Denial Order.
On July 21, 2014, we reported on San Diego Gas & Elec. Co. v. Schmidt, Case No. D062671 (4th Dist., Div. 1 July 21, 2014), where condemnees winning over an $8 million open-pit mining judgment also obtained a reversal of a lower court order denying them recovery of litigation expenses under CCP § 1250.410. We have a follow up for you—this one has now been fully certified for publication on August 14, 2014, both on the merits and fees aspects of the case.
