On March 19, 2016, we posted on U.S. District Judge John A. Kronstadt’s tentative decision to deny fees to Marvin Gaye’s estate in a copyright infringement case in which Robin Thicke and Pharrell Williams were found to have infringed on one of Mr. Gaye’s iconic songs later in the popular “Blurred Lines” song. Well, on April 12, 2016, the district judge finalized his decision that no fees were warranted, because the case presented novel issues and it was far from clear who would win—with merely prevailing not being enough to recover under the copyright fee-shifting statute. However, District Judge Kronstadt did order resubmission of papers so that the winner could recoup 65% of expert witness fees, deposition transcript costs, and certain service of process expenses.
