However, Frivolous Appeal Sanctions Denied For Failure To Show The Appeal Was Brought For An Improper Motive.
In Lazo v. Keller, Case No. G058765 (4th Dist., Div. 3 July 29, 2021) (unpublished), two plaintiffs separately were ordered by the lower court to pay $4,900 in monetary discovery sanctions to defendant. Plaintiffs’ appeal was dismissed in a 3-0 opinion authored by Justice Fybel. The reason was that the sanctions order did not exceed $5,000 such that it was not appealable, requiring a dismissal of the appeal. (Code Civ. Proc., § 904.1(a)(12).) Defendant moved for frivolous appeal sanctions, but that request was denied because there was no evidence it was brought for an improper motive. (In re Marriage of Flaherty, 31 Cal.3d 637, 650 (1982) [our Leading Case No. 9].)
