Reason Is That Plaintiff Was Not Allowed A Jury Trial.
A jury trial is a fundamental right; if that right is abridged, a reversal of a merits judgment and post-judgment fees award may well occur, as it did in Miralda v. Wu, Case Nos. B306324/B313954 (2d Dist., Div. 1 Nov. 2, 2022) (unpublished).
What happened here is that plaintiff obtained a $55,480.60 judgment in a wage/hour bench trial, followed later by a $150,505 fee award. All of that went away on appeal, since plaintiff was improperly denied her request for a jury trial (which was made by another defendant, but which also inured to the benefit of the other defendant not being allowed a jury trial and suffering an adverse court decision).
