Self-Represented In Pro Per Plaintiff Could Not Surmount Abuse Of Discretion Standard On Amount Of Fees.
We know by now that the SLAPP statute has a mandatory fee-shifting provision in favor of successful defendants. So unless timeliness is an issue, the amount of the fees to be awarded is usually the pivotal issue. In Doe v. NBCUniversal Media, LLC, Case Nos. H050444 et al. (6th Dist. June 11, 2025) (unpublished), two sets of defendants were awarded, respectively, fees of $9,882.14 and $43,564.90 for winning SLAPP grants. Plaintiff, in pro per on appeal, did not challenge the larger award and was unable to shake the abuse of discretion standard sustaining the lower award.
